INTELLECTUAL PROPERTY RIGHTS PROTECTION IN THE ERA OF ONLINE PLATFORMS AND GENERATIVE ARTIFICIAL INTELLIGENCE: PROBLEMS OF QUALIFICATION OF VIOLATIONS AND ALLOCATION OF RESPONSIBILITY

The article analyzes the problems of intellectual property rights protection in the context of the development of online platforms and the use of generative artificial intelligence. The difficulties of qualifying copyright violations and the distribution of civil liability between users, platforms and AI providers are considered. Based on the norms of Part four of the Civil Code of the Russian Federation, the doctrinal positions and practice of the Intellectual Property Rights Court, key areas of legal uncertainty related to the training of generative models, the status of the generation result and the application of the liability regime of information intermediaries are identified.
