ОСНОВНЫЕ ПРОБЛЕМЫ ВЗЫСКАНИЯ УБЫТКОВ ПРИ БЕЗДОГОВОРНОМ ПОТРЕБЛЕНИИ ЭЛЕКТРОЭНЕРГИИ

Due to the annual increase in the number of disputes arising from contractual obligations due to unauthorized connection to the consumer's power receiving devices, the issue of compensation for real damage in the form of electric energy costs is of particular interest. The article presents the main problems of recovery of losses caused by unauthorized connection to the electric networks of economic entities in the absence of contractual legal relations. The author analyzes the main steps to the successful satisfaction of claims in disputes related to compensation for damages in case of non-contractual consumption of electric energy, with reference to examples from judicial practice in the most significant court cases. The author presents arguments that distinguish between the concept of "losses" and "unjustified enrichment" when formulating claims to the court, in order to prevent a double interpretation and improve the effective work of judicial bodies.
