The article examines the theoretical and law enforcement aspects of taking into account mitigating and aggravating circumstances when imposing disciplinary liability by law enforcement officers. Based on the analysis of the current state of legislation, as well as the positions of the scientist, the necessity of unifying approaches to fixing these circumstances is substantiated. The study demonstrates that the lack of a clearly structured mechanism for accounting for mitigating and aggravating factors creates legal uncertainty, reducing objectivity and individualization of responsibility.
