The problem of punishment, which is not bound up with isolation from the society

The process of formation of a democratic and socially oriented state in Russia encourages criminal justice to humanize punishment. Among the punishments there appear those not connected with the isolation from the society. This process is accompanied by a number of new problems taking attention away from the optimization of crime prevention. The new contradicting situation directs methodology towards the solution of two interconnected tasks: identification of punishment problems and their solution. Scientific search means for solving the problem, arising around criminal punishments, which are not bound up with isolation from the society, allowed the author to fix a number of conformities. Firstly, the author could determine the systemic nature of rather wide circle of problems, which is contoured by modern researchers, arising due to the criminal punishment, not connected with isolation from the society. Secondly, optimal way of solving these problems is determined – the application of systematic method of approach. It is done due to systematic nature of given problems.
