Constitutional basis for criminal law protection of computer data

This article discusses the issues concerning constitutional basis for criminal law protection of computer data. The author suggests that basic principles of information relations are regulated by the norms of constitutional law and protected by the criminal legislation. The mechanism of information protection can be defined as a system of legal norms and guarantees, which are aimed to protect human rights and freedoms in information sphere and to define responsibility for their violation. Computer data security in Russian Federation provided the security of computer data is provided by interconnection of constitutional and criminal law, when constitution law define the legal status of subjects of information relations while criminal law provide the basis and conditions for criminal prosecution of socially dangerous acts against information sphere.
