The article deals with the legal regulation of issues related to the preparation and further professional education of employees. The authors note that the right to enter into the contract student is granted only to legal persons. According to the Federal Law "On Education in the Russian Federation", individual entrepreneur may carry out educational activities for primary and secondary general education programs, as well as the program of vocational training, but the right to perform additional professional education it is not granted. According to the authors expressed in the legal literature proposals for the right to enter into an apprenticeship contract to individual entrepreneurs do not meet the development trends of the training staff at the present stage of legislation. The article provides an overview of the different points of view on the legal nature of the apprenticeship contract. The authors believe that the contract with a person seeking employment is mixed, civil and labor-law character. employee qualification Feature receives regulatory and legal consolidation in the form of a professional standard, which not only serves the objectives of unification of qualification requirements for professions and taken into account in establishing the tariff system of remuneration, but also serves as a basis for the development of educational standards and professional training and education programs.
