Guarantees of individual rights during the search in the criminal procedure legislation of Russia and Iraq: comparative analysis

The article discusses criminal procedure, especially search as one of the key investigative actions in the criminal process of Russia and Iraq. The investigation of factual and legal bases of search. Analyzes discussion question about the possibility of carrying out a search on the basis of in-formation obtained from investigative sources. A comparative analysis of the provisions of the code of criminal procedure and the criminal proce-dure code of Iraq, on the production of various types of search. Formulat-ed proposals to improve the criminal procedure legislation of Iraq to en-sure the rights and freedoms of the individual during the search.
