Passing courses of psychotherapy persons, violating part 1 article 12.8 of the Code of the Russian Federation about administrative offenses as a condition of legal incentive

The article deals with the problem of constant increase of traffic accident with participation of drunk drivers. Analyzes the causes of this phenomenon. Special attention is to the issue of the lack of fear of drivers before the punishment. The author comes to the conclusion, that in this case, you need to act not from a position of tightening up sanctions, but from the perspective of legal incentives, it is proposed that it is necessary to apply not only to the penalty of deprivation of the special right, and a training course of psychotherapy aimed at changing the attitude of drivers to driving under the influence of intoxication. On this basis it is proposed to implement a legal incentive for the early return of the drivers license in case of voluntary therapy, the purpose of which will be to reduce the number of pending offenses.
