The article deals with problematical aspects of civil procedural representation approach to Russian and foreign law. The author provides the reasoning of rep-resentation as a potestative legal relation between constituent and his representa-tive. The relation between representative and court is derivative from the relation between him and his constituent. The author refers the procedural representative to be the case participant de facto, and the bearer of rights, obligations and liabil-ity in accordance with sector-specific legislation as well.
