Juridical Mistake in the Criminal Law and Generally Lawful Principle of the Presumption of the Erudition of Law

The article considers the correlation of the generally lawful principle of the presumption of the erudition of law to the criminal law category “juridical mistake”. The analysis of the functioning legislation as well as the legislation of Russia in its historic retrospective is carried out. The doctrinal questions of the criminal law institutions of the juridical mistake are considered. The position of the author is argued on the question of the expediency of the legislative consolidation of the notion “juridical mistake” as well as of the regulations of the qualification of the criminal acts in the presence of them.
