On legal regulation of activity of the state enterprises in the Republic of Azerbaijan

Problems of formation of an effective control system of state ownership as one of the bases of the economy of the state, and also the prospect of further existence of the state enterprises acquire special relevance today. Need of preservation of state ownership and commercial interest, duty of maintenance of activity of the state enterprises for especially significant sectors of economy and practical exhaustion of measures for increase in efficiency of their functioning. Inefficient, from the point of view of management, managing of the state enterprises, the practice of reforming of the state enterprises advancing the legislation - the factors testifying to incompleteness of civil regulation of participation of the state enterprises in a commodity turn as full-fledged business units. Collisions in the theory of civil law and in practice are a consequence of the specified tendencies. From the point of view of creation of fields of elimination of the existing defects in the legislation and the regulation connected with the state enterprises (covering kinds of activity and legal providing, the rights and duties), it is considered to adopt expedient the Law of the Azerbaijan Republic "About the state enterprises" as one of effective legal documents.
