Civil liability of persons controlling a credit institution

the article deals with the problematic issues of bringing to responsibility of controlling debtor entities in the bankruptcy case in violation of the principle of good faith and reasonableness. The article analyzes the main provisions of the legislation on responsibility of leaders, distinguishing wrongfulness of his behavior from guilt, determine the signs of the unfair and unreasonable actions (inactivity) of the persons comprising the legal entity. The article discusses the issue of allocating the burden of proof of good faith and reasonableness of management behavior.
