Land disputes: the concept, signs, classification, resolution features

Land disputes occupy a special place among other legal proceedings, which is explained by the significance of the land and its resources. Land disputes arise when actions of participants in land relations (including state bodies) or their unjustified inaction violate someone's rights and interests. The article is devoted to the study of the concept, essence, causes and procedure for resolving land disputes. The article highlights approaches to the definition of the concept of land disputes, analyzes legislation on this topic, examines various types of land disputes and their features. The possibility of distinguishing the land process as an independent legal institution and its legislative consolidation in the regulatory legal acts of the Russian Federation was studied. The author, based on the analysis of the opinions of scientists and legislative decisions in various countries, proposes the creation of specialized judicial bodies for the competent and fair settlement of land disputes.
