To the question of the legal regulation of the mechanism of a child

This article is devoted to analysis of the ripened need of improvement of the mechanism of implementation of the Institute of a child in the context of article 77 of the Family code of the Russian Federation. It is considered features of application of this article, including in the light of the recently adopted resolution of the Plenum of the Supreme Court of the Russian Federation from November 14, 2017 n 14 "About practice of application by courts of the legislation on the settlement of disputes related to protection of rights and legal interests of the child at direct threat to his life or health, and when the restriction or deprivation of parental rights." In conclusion the author proposes recommendations for improving the analyzed legal phenomenon.
