The volume of legal capacity of the management company exercising trust management of mutual investment fund

The article is devoted to the analysis of the volume of the legal capacity of the management company, which performs trust management of the mutual investment fund. In the course of the research, the author, from the point of view of separation in the civil legislation of the legal capacity for general and special consideration, examines the scope of the powers of the management company that carries out the trust management of the mutual investment fund. Considering legal capacity as the quality of the organizational and legal form, the author defends the view that the existence in the federal law of bans on combining various types of activities, as well as licensing requirements, does not constitute the special legal capacity of such legal entities.
