The article considers the main problematic issues in the field of representation in organizational and managerial relations, in particular, the article deals with issues with respect to the primary trade union’s authorities on representation of the employees’ interests, considers the gaps and contradictions in legislation on employees’ representation, suggests the ways to solving those problems, addresses the issue on necessity to amend the current employment legislation with such subject of social partnership as collective of employees, identifies the most problematic issues regarding the rights of the trade union in creating conditions for its activities, the participation of trade unions and other employees’ representatives in the company’s management bodies, suggests a critical analysis of the draft Federal Law No. 1041537-6, as well as provisions of Art. 5.28-5.34 of the Code of Administrative Offenses of the Russian Federation with regard to the administrative responsibility of the employer in connection with the violation of the collective labor rights of employees, makes proposals on improving the norms of labor and administrative legislation in relation to the said issues.
