It is obvious that additional qualification of a crime is based on certain principles and occurs according to certain rules. It is only necessary to isolate and analyze them. This can be assisted by the theory of qualification of crimes, especially in the framework of which the principles and rules have already received coverage.
The principle is the main starting position of any theory, doctrine, science, philosophy, theoretical programs, and rule - provision, which reflects the pattern, the constant ratio of any phenomena. Thus, in criminal law, in our view, the principle should recognize the relevant starting position, and the rule - a specific provision reflecting a certain pattern or constant ratio of criminal law phenomena.
