Based on the study of signs of illegal actions in bankruptcy, this article identifies the main shortcomings of the current criminal and related legislation and formulated proposals for its improvement.
Based on the logic of the elements of the crime, the article also highlighted the shortcomings of the legislative description of the subject of the crime in article 195 of the criminal code.
