In article are considered questions of preparation for carrying out investigative actions — the control and record of negotiations. The complex of actions which is carried out at the preparatory stage of investigative action increasing its efficiency is resulted. The author analyzes the information available to the investigation from the standpoint of sufficiency to establish the circumstances of the event under investigation, its nature, the participants who performed their roles. The author notes that the assessment of the investigative situation is not limited to the study of the materials of the criminal case, because the investigator evaluates all information known to him, including not reflected in the documents in the case. The article deals with the actual and legal grounds for the production of this investigative action. As an important element of the preparation of the action under consideration, the study of the personality of the subjects whose negotiations are planned to monitor is highlighted.
