The article analyzes the grounds, conditions and application of a preventive measure as house arrest, considers the possibility of using the results of operational investigative activities as basis for selection house arrest, justifies the need to improve legal regulation for the selection and application of house arrest as a preventive measure. In addition, the article draws attention to the incompatibility of the court’s competence to elect a preventive measure in form of house arrest to the principle of competition and equality of sides.
