Legal consequences for harm caused by lawful activities

The authors of the article examine the issues of compensation for damage caused by lawful acts. As a problem, the legislator's dual approach to the consequences of compensation for such harm is noted. In some cases, the rule of full compensation for damage is established, in others - the obligation of the state to compensate for the damage arises, but only within the framework established by the executive authorities. The authors note the ambiguity of the terminological interpretation of the concepts of “compensation of harm” and “compensation of damage” and come to the conclusion that the term “compensation of damage” is more preferable to the analyzed issue and suggest amendments to the current legislation.
