The role of arbitration courts in monitoring and facilitating arbitration

In this article, an arbitration court means a sole judge or a council of arbitrators who consider disputed issues of a civil law nature that arise in the course of entrepreneurial or other economic activity. In Russia, arbitration institutions (arbitration courts) are created with non–profit organizations that have received the right to carry out their functions, but they are not state. The enforcement of the decision of the arbitration court occurs after the arbitral tribunal recognizes this decision and takes measures to enforce it; The arbitral tribunal is not entitled to take measures to secure the claim in question. A statement about the adoption of such measures must be addressed to the arbitration court. The arbitration courts monitor the legality of the content of judicial acts handed down as part of the arbitration proceedings and assist in obtaining evidence in the case and enforcing judicial acts.
