Legal regulation of the franchise agreement in Russia and the USA: comparative legal analysis

Franchising is one of the most convenient forms of doing business. Franchising companies operate all over the world. The directions of development of franchising activities are constantly discussed at both international and national levels now. International organizations adopt legal acts, model laws governing this type of activity. In the Russian Federation, franchising activity is at the beginning of its development. The laws and legal practice of the Russian Federation contains many obstacles and errors that need to be addressed for the further development of this form of business in our country. The elimination of such shortcomings will attract investment from abroad. To consider and solve these problems in this work the legislation and judicial practice in the field of franchising in Russia and in the most successful country in this area, in the United States, in which a huge breakthrough in the development of franchising occurred in 60-70 years, were considered, a comparative legal analysis of the legislation and practice of the two countries was carried out. As a result, conclusion was made about what measures should be taken for the further development of franchising in Russia.
