Mechanisms for extraterritorial protection of trademarks

The article concerns the phenomenon of extraterritoriality in the legal protection of trademarks. The author highlights the mechanisms of extraterritorial regulation of relations related to the protection of trademark rights, namely: national extraterritorial regulation and international legal models of legal protection of trademarks. The author analyzes national extraterritorial regulation of trademark rights and characterizes the extraterritorial international legal models, such as legal protection of a well-known trademark; legal protection of a trademark under international registration; the regional models of legal protection of a trademark (EU and EEU trademarks). The author predicts gradual overcoming of the phenomenon of territoriality in the field of trademark protection by means of harmonization and unification of law.
