Labor relations of incapacitated, disabled, persons with social security

Hronova Irina Alekseevna  (candidate of historical Sciences, associate Professor, Kuban State Technological University, Krasnodar)

global modernization trends that affect the concept of human rights initiate the formation of a new perception of the legal status of the population group in the field of labor studied in this paper. The article shows that the paradigm underlying the legal regulation of labor relations of disabled people, incapacitated citizens, and persons with disabilities is gradually becoming outdated. And it should be replaced by an understanding that a systematic approach to the rehabilitation of these citizens is required, including through involvement in labor activities and professional adaptation. However, today, the Russian legislator, unfortunately, is still at the stage of «qualified silence» when it comes to entering into labor-law relations with the studied category of persons. These circumstances lead to some asymmetry in the implementation of the labor rights of persons in need of legal protection, which allows us to conclude that further research is needed on these issues and develop proposals for the introduction of new legislation that can correct the situation.

Keywords:disabled persons; subjects of labor law; persons with disabilities; quotas; legal capacity; labor legal personality.
