The concepts of “corruption” and “administrative and legal measures to combat corruption” in the Russian legal doctrine and legislation

This paper touches upon the issues of ambiguity of the perception of the term "corruption "in scientific research; in the meaning formulated by the legislator; and in its "everyday" interpretation, which has been formed in the legal consciousness of the Russian population. The problems of legal and doctrinal definition of the concept of "administrative and legal anti-corruption measures" and classification of these measures are studied. Object: to analyze scientific publications and legislative acts in order to form a correct terminological apparatus and a theoretical basis for the knowledge of objective laws related to the development and implementation of anti-corruption measures. Methods: as in most civil studies, general theoretical methods were used in the work - generalization, analysis, induction, as well as logical and statistical methods, from private legal methods the author chose a formal logical interpretation of law and a comparative legal method. Findings: despite the significant differences in the understanding of the term "corruption "at the scientific, legislative and everyday levels, the common components of this term are identified, taking into account which it is possible to improve the scientific and legal definition of corruption, the author's definitions of the terms" corruption "and"administrative and legal measures to combat corruption" are proposed.has summarized some aspects features of construction of norms of the material and procedural law regulating a subinstitute of a judicial penalty. The problems of theory and practice related to the scope of judicial discretion in the appointment of another measure of a criminal nature in the form of a judicial fine, and other problems of procedural implementation of exemption from criminal liability on this basis are studied
