this article provides an analysis aimed at establishing the features of the functioning and development of such a civil law institution as a marriage contract. The authors, building a model of logical understanding of the activities of such an institution through the prism of problems arising in connection with its use in family relations, give examples of what exactly causes the consequences of the misuse of its mechanisms and what is the difference between this institution and others similar to it. on civil law grounds. In addition, the authors touch upon the development of modern contractual relations and the role of this agreement in their assessment and resolution.
