On the issue of digital transformation in jurisprudence: a theoretical and legal view

Objective: to identify the causes and characteristics of the legal crisis in jurisprudence associated with technological progress and to propose solutions. Methodology: the methodological basis of the research is a set of methods of scientific cognition, including abstract-logical, comparison, content analysis, as well as tools of the methodology of convergent technologies. Scientific novelty: it is customary to list regulatory problems in the scientific literature, but the issues of legal theory are not covered in sufficient detail. In particular, contradictions are found between the issues of regulation and doctrinal understanding of innovations and basic theoretical and legal concepts. Results: the main directions of the crisis in jurisprudence related to the lag of law from technology are listed, including methodological, doctrinal and regulatory aspects, a list of theoretical and legal problems is developed and regulatory and doctrinal responses are proposed.
