The entrepreneurial code of Kazakhstan and the legislation on entrepreneurship activities in Russia

The article analyzes approaches to the issue of codification of the norms of business law in Russia, examines the argumentation of representatives of various scientific schools. The structure of the Entrepreneurial Code of Kazakhstan is analyzed, a comparative legal analysis of the legal provisions of the Entrepreneurial Code of the Republic of Kazakhstan with legislative norms on entrepreneurship in Russia is carried out. The principles and norms of the code are highlighted, which, according to the author, could be used in the state regulation of entrepreneurial activity in Russia. In particular, the principles of social responsibility of entrepreneurship are relevant; limited participation of the state in entrepreneurial activity; mutual responsibility of business entities and the state; norms on participatory procedure; norms that entrepreneurs have the right not to allow officials of state control and supervision bodies to check in cases of non-compliance by officials with the requirements for conducting an audit, etc. The article also provides arguments and draws conclusions about the expediency of codification of legislation in the field of entrepreneurship in Russia. The methodological basis of the scientific article consists of general scientific methods: dialectical method of cognition, methods of system analysis and synthesis, as well as private scientific methods: comparative legal, formal logical and other methods of cognition.
