Termination of ownership right to real estate

The right of ownership is an extensive property right, therefore, it is necessary to legally regulate not only the prerequisites for the emergence of ownership rights, but also the termination of these relationships. In Russia, at the present stage, a set of tools has been formed that allows, if necessary, to withdraw a dwelling for state needs. This happens in situations where an object of national importance should be located on the owner's territory. An example is a highway, a power line, and a similar need arises during the construction of oil pipelines, highways, power lines, water pipelines and other communication systems. The change in the nature of social relations during the period of a market economy has led to the need to change and clarify the legal regulation of the termination of rights to a dwelling, including in the event of the demolition of an apartment building in which such a dwelling is located. It is worth noting that situations related to the unauthorized seizure of land are especially relevant. In this case, in connection with the current legislation, there can be no compensation, moreover, a fine will be imposed on the offender. An effective mechanism for the protection of property rights is envisaged, but the implementation of the norms is complicated precisely by the incurred budget expenditures.
