Some problematic aspects of absentee proceedings in the civil process in Russia

The article is devoted to the analysis of problems related to the consideration of civil cases and the issuance of final judicial acts by courts in the framework of correspondence proceedings. The authors consider the effectiveness of this institution in the modern procedural law of Russia from the point of view of the existing problematic aspects. It is noted that insufficient legislative elaboration of the legal norms regulating correspondence proceedings does not allow achieving the goals that were pursued when introducing this procedure into the Civil Procedure Code of the Russian Federation. The procedural role of this institution is assessed by the authors as insufficiently effective, possible ways of solving existing problems are given in order to make the correspondence proceedings more efficient and rationalized.
