This article discusses the problematic aspects of the functioning of the institution of bankruptcy of individuals in the Russian Federation. The author analyzed various problematic situations and current regulatory approaches in relation to the bankruptcy of individuals, identified a number of existing problematic aspects of the legislation. It is noted that in order to increase the efficiency of the functioning of the institution of bankruptcy of individuals in the Russian Federation, it is necessary to introduce certain changes to the current legislation.
