WEAKNESS IN THE LEGAL RELATIONSHIP OF OBLIGATIONS: PROBLEMS OF IDENTIFICATION

The author concluded that only a party that has unequal negotiating opportunities due to its inability to influence the formation of the content of the contract or its individual conditions should be recognized as weak. To recognize a business entity as a party with unequal negotiating opportunities, it is required to establish an increased standard of proving the disparity of negotiating opportunities.
