THE INSTITUTION OF AN AGREEMENT WITH THE REGULATOR AS A BASIS FOR EXEMPTION FROM ADMINISTRATIVE RESPONSIBILITY FOR OFFENSES IN THE FINANCIAL MARKET

The article analyzes the institution of an agreement with the Central Bank of Russia, which is new for Russian administrative law, within the framework of which there is an exemption from administrative responsibility for certain offenses in the financial market. On the basis of the comparative legal method, the study of the specifics of the regulatory regulation of the institution of the Agreement is based both in the current legislation and in draft laws. It is revealed that, by its legal nature, the Agreement with the regulator is an analogue of the "deal with justice" (transaction), which is widespread in world practice. The conclusion is made about the significance of the institution of the Agreement, its definition is formulated from an administrative and procedural point of view. A number of provisions of the current legislation requiring adjustments are noted, gaps in regulatory regulation are identified.
