One of the most important facts hindering the full and concise development of entrepreneurial activity at the present time is the obsolescence of the administrative and legal foundations in the Russian Federation, as the role of entrepreneurial activity among citizens of the Russian Federation increases every year, and, as a result, improvement of the current legislation is required. From the point of view of legal science, the administrative and legal foundations of entrepreneurial activity are legal norms, and determine the basis of knowledge about them, updates the understanding of the principle and rules of the foundations of entrepreneurial activity. Thus, in order to overcome the barriers that act as a "brake" of the legal system in the sphere of decent economic prosperity of the state, it is necessary to turn to the administrative and legal foundations (origins) of entrepreneurial activity.
