ISSUES OF QUALIFICATION OF MALFEASANCE IN THE FIELD OF PUBLIC PROCUREMENT

The author examines problematic issues of qualification of criminal acts committed in the field of public procurement by officials of the customer, in particular, from the point of view of qualification based on the characteristics of the subject of the crime. Attention is paid to the consideration of the status of categories of persons influencing the object of criminal legal protection, established by Articles 200.4 and 200.5 of the Criminal Code of the Russian Federation, in order to distinguish between the subjects of these crimes and other related crimes.
