GENERAL PRINCIPLES OF CONSTRUCTION OF EXPRESS TERMS IN ENGLISH CONTRACT LAW

The article analyzes in detail the process of construction of express contractual terms by English courts. Using concrete examples, the author examines general guidelines on construction, accumulated by modern judicial practice. The conclusion is made about consecutive character of construction process – from analysis of contractual wording to determination of meaning of the contract as a whole and identification of parties’ original intents.
