THE CONCEPT OF THE IDEA OF A LEGAL STATE: THE EVOLUTION OF VIEWS

The concept of the rule of law has been the focus of attention of theorists since the very birth of such a form of organization of social life as the state. The study of this phenomenon was carried out by thinkers of antiquity, the Middle Ages, and modernity. The problem of building a legal state was in the field of view of philosophers, lawyers, historians, regardless of their views and judgments. However, the meaning of the idea of a legal state was different for thinkers, political and public figures. Regardless of the views and judgments about the rule of law, the existence of the latter was invariably associated with the triumph of humanism, law, legality, and justice. The phenomenon of the rule of law was not only studied, but attempts were made to recreate it in reality, although not to the full extent. It is important to understand that the rule of law is not just an idea of universal equality and the rule of law, but a complex system based on interrelated elements, and if you miss any mechanism, then chaos will begin, and the concept will not work as it should. The formation of the rule of law is a process that can take place only if all conditions are met, it can be achieved only by a reformist method. As the work showed, the rule of law is a set of ideal functioning of the economic, political, legal, spiritual and social spheres of society. It also turned out that the most important part of the rule of law is the presence of a civilized, educated civil society.
