LIMITED SANITY OF PEDOPHILES

The author considers topical issues of criminal liability of pedophiles and the application of criminal law measures to this category. An analysis of the current legislation indicates the need to specify the rules of law in order to eliminate discrepancies in the appointment of this category of punishment and compulsory medical measures. The purpose of the study is to study the problems in terms of the application of the norm on the limited sanity of pedophiles and to make the necessary proposals for improving the criminal legislation. Objectives: to identify problematic aspects in the legislative regulation of the criminal liability of pedophiles and recognize them as limitedly sane; analysis of the views of scientists and practitioners on this issue in order to consolidate unsettled provisions at the legislative level. Methodology: When writing the work, general scientific methods (analysis, synthesis, induction, deduction), as well as formal-legal and formal-logical research methods were used. Conclusion: On the basis of the study, we can conclude that pedophilia is a mental disorder that does not exclude sanity, in relation to which the most effective measure is a combination of punishment along with coercive medical measures, and not, as is customary in practice, the appointment and application of punishment alone. In order to reduce the number of pedophilic crimes, it is necessary to improve the norms of the current criminal legislation in terms of crimes against the sexual integrity of minors.
