UNAUTHORIZED PUBLIC EVENT: CONFLICT OF THEORY AND PRACTICE

The work is devoted to the consideration of the question of the validity of classifying public events as “unauthorized” in the event that the non-compliance of the purposes, forms and other conditions of its conduct specified in the proposal of the public authority with the requirements of the legislation indicated in the notification is not eliminated. Analyzing the provisions of the current normative legal acts, the explanation of the Supreme Court of the Russian Federation on this issue, the research of modern researchers, the author comes to the conclusion that there are conflicts between the theories of the right to freedom of assembly and the current law enforcement practice, gives recommendations for their resolution.
