ON THE QUESTION OF THE LEGAL REGULATION OF THE SUBJECT OF PROTECTION OF A CULTURAL HERITAGE

An analysis of current legal acts and methodological recommendations has been conducted, revealing the shortcomings of the existing system, including imperfections in federal legislation regarding the mandatory nature of state historical and cultural expertise. Special attention is given to the guidelines of the Moscow City Committee on Culture, which serve as an example of the main principles for preserving significant elements of cultural monuments. The author emphasizes the role of historical-cultural research and the importance of qualified state experts in the process of assessment and preservation of cultural heritage. The article calls for improving the effectiveness of legal mechanisms for the protection of cultural heritage through stricter requirements for licensing organizations that determine the subject of protection and by establishing mandatory methodological instructions for various categories of heritage objects.
