PRACTICAL ISSUES OF AN ADDITIONAL PATENT FOR AN INVENTION AS A STUDY OF JUDICIAL PRACTICE ON THE ISSUE AND CONCLUSIONS

The study is devoted to the study of topical issues of patent extension for inventions and in particular focuses on the impact of domestic judicial practice on the development of patent law in the Russian Federation. As part of the study, it was noted that the system of additional patenting is objectively necessary not only to maintain the commercial and other related interests of copyright holders of exclusive rights to an invention, but also to stimulate innovation, as well as to ensure the validity of extended patent validity periods necessary for complex clinical, environmental and other similar studies that ensure the safety of the final object of intellectual activity according to an additional patent. Despite the importance of the legal framework governing relations on additional patenting, it is noted that legislation in this area is constantly being transformed taking into account the needs of copyright holders. Based on the materials of the Intellectual Property Rights Court of the Russian Federation, it is noted that in this direction it is possible to trace the importance of the judicial practice of the Intellectual Property Rights Court of the Russian Federation for the development of the legal framework governing patent legal relations in the Russian Federation.
