DIRECTIONS FOR THE DEVELOPMENT OF MECHANISMS FOR PROTECTING THE RIGHTS OF PATIENTS IN CASE OF MEDICAL ERROR

This study conducts an in-depth analysis of the existing judicial practice in the field of patient rights protection. Despite the constitutionally enshrined status of human life and health as the highest social value, as well as the priority of the healthcare sector, cases of violation of patients' rights are systematically recorded in medical practice. According to available statistics, medical error is the most common factor causing such violations. At the same time, it should be noted that, despite the significant amount of research devoted to the analysis of medical errors in the context of specific diseases, the legal aspects of this problem require a deeper and more comprehensive study. This study examines the social relations arising in the field of medical activity in connection with the commission of medical errors and the exercise by patients of their legal rights. The article also analyzes a set of scientific works and the main legal norms governing relations related to medical errors and the protection of patients' rights. The purpose of the study is to conduct a comprehensive analysis of the legal problems arising in connection with medical errors and to develop proposals for improving legislation in this area.
