The article discusses issues related to such a negative phenomenon as illegal bankruptcy, which undermines the stability of the economic system and causes significant damage to the state and the financial market. The authors analyze the concepts and forms of illegal bankruptcy, the causes and conditions conducive to their commission, and the legal framework of the Russian Federation governing bankruptcy procedures. In addition, a comparative analysis of the criminal law characteristics of forms of illegal bankruptcy, such as intentional and fictitious bankruptcy, is carried out. The issues of competence and powers of subjects of the system of state bodies, whose activities are aimed at countering the negative phenomenon under consideration, are raised. The means and methods used in the fight against unscrupulous debtors are being considered, and proposals for their improvement are being made.
