PUBLIC ORDER OF THE INTEGRATION UNIONS: EAEU AND EU PRACTICE

The public order of integration unions is a relatively new legal concept. It is based on the core values shared by members of the respective unions and is protected by principles and legal provisions that prevail over those of national public order. The public order of integration unions, however, cannot extend to spheres of legal regulation that have not been delegated by member states to the level of the respective union. It has been proved that public order of the EAEU is still establishing, whereas in the EU it is an established category that has, in recent years, prevailed over international public order, which may conflict with the principles and provisions of international law.
