LEGAL ISSUES IN COMPETITIVE PROCUREMENT (FEDERAL LAW NO. 44-FZ) OF NECESSARY GOODS BY HEALTHCARE CUSTOMERS

The article examines legal problems arising when government healthcare customers carry out competitive procurements under Federal Law No. 44-FZ. The study analyzes the conflict between competition requirements and the objective need of medical institutions to purchase specific goods. Based on the analysis of regulatory acts, FAS Russia positions, and arbitration practice, the main legal mechanisms used by customers to justify special procurement requirements are systematized.
