LEGAL BASIS AND PROCEDURE FOR THE EMERGENCE OF DIGITAL RIGHTS

The article considers the grounds and procedure for the emergence of digital rights in modern law, taking into account the development of digital technologies and the digital economy. The author analyses the legal nature of digital rights, their correlation with traditional property and compulsory rights, and the specifics of their consolidation in legislation. Particular attention is paid to legal facts leading to the emergence of digital rights, including electronic transactions and the use of information systems. The study focuses on the implementation and protection of digital rights, as well as the challenges of law enforcement. It is concluded that further improvement of legal regulation is required to ensure legal certainty and stability of civilian turnover in the digital environment.
