Legal basis of formation of the first Islamic state as institute of a contractual origin

In this article the normative legal acts regulating the public relations in a Muslim community in the 20th years of the VII century which became subsequently a kernel of the Arab caliphate are considered. The translations of these documents are given in article and the analysis is carried out them. Respectively, a number of conclusions about that becomes it is possible to consider the Arab caliphate as institute of a contractual origin.
