In given article the basic aspects of the legal status of the domain name. The analysis of the current legislation in conjunction with the judicial practice. Produced an overview of some court cases of France and the United States, on the basis of which the approaches to understanding the domain name. The expressed opinion about the need for further study of this problem in order to formulate steps to improve the legislation.
