This article discusses aspects of the interaction of law and policy in criminal prosecution. The author analyzes criminal policy as the basis of normative and law enforcement activities to protect the individual, society and the state from criminal attacks. He points out that the orientation of modern criminal policy to reduce the level of criminal law pressure on business is manifested not only at the legislative but also at the law enforcement level. The author shows that the transformation in this direction has undergone both material and criminal procedural law. At the same time, he notes that the criminal and political goal of minimizing illegal interference in business activity is not objectionable, which cannot be said about the legal means to achieve it, since reducing the level of repressive pressure on business is achieved through the creation of a special privileged criminal law regime for entrepreneurs. In conclusion, the author concludes that all persons, regardless of their social status, should be equally protected from illegal criminal prosecution, which requires appropriate reorientation of legislative and law enforcement efforts.
